Whilst the Right to Manage can solve many leaseholders’ problems those leaseholders still do not own the freehold to their properties: their leases are still wasting assets. This problem can be solved by claiming the right to enfranchise, or buy the freehold to, the property.

Claiming the right to enfranchise is a more complex and more expensive process than the Right to Manage. The current freeholder has to be paid a sum for the freehold – rules for determining this sum are set out in the legislation, but there are still many variables and the values of the flats have to be determined. It is usually correct to engage a chartered surveyor for the valuation, whom we can recommend to you.

As for the Right to Manage there are conditions which must be satisfied – the conditions are actually similar to those required for the Right to Enfranchise. We can explain these conditions to you, advise you if you qualify, and prepare a plan for the whole process, to include possible informal negotiations with the freeholder and the service of legal notices if necessary.  Our policy, as always, is to involve solicitors only where necessary.

We advise that the freehold is purchased by a company, of which the leaseholders are members. We can set this company up and guide you as to its operation.
